General information about accredited bodies for international adoption mediation
Accredited bodies for international adoption (hereinafter, OAA) are non-profit entities registered in the corresponding register, whose purpose is the protection of children.
The OAA will carry out their activity throughout the national territory, providing their services to people who offer themselves for adoption with habitual residence in Spain.
Their actions abroad will be limited to the country or countries for which they have been accredited. Furthermore, they must comply with the requirements and conditions that may be established by the child's country of origin.
- Functions performed
In the exercise of their international adoption mediation functions, the OAA's actions will be limited to the activities indicated in the accreditation resolution and must be carried out under the terms and conditions established therein.
However, the OAA may have among their purposes and activities the provision of other social services and child protection, provided that the international adoption mediation activity is clearly identified, differentiated, and separated from the rest of their actions, especially concerning their statutes, organizational structure, and accounting.
No person or entity other than the OAA and the competent public entities can intervene in international adoption mediation functions.
The OAA must have the necessary material means and multidisciplinary teams for the development of the entrusted functions throughout the national territory and be directed and managed by people qualified for their moral integrity, training, and experience in the field of international adoption.
International Adoption Mediation is understood as any activity aimed at contacting the person/s offering for adoption with the authorities, organizations, and institutions of the country of origin or residence of the adoptable children, as well as providing the necessary assistance for the adoption to take place.
- Information to interested parties on international adoption.
- Advice, training, and support to the people offering for adoption on the meaning and implications of adoption, relevant cultural aspects, and the necessary procedures to be carried out in Spain and the children's countries of origin.
- Mediation in the processing of adoption offers between the competent Spanish and foreign authorities.
- Carrying out procedures to fulfill post-adoptive obligations established in the legislation of the adopted child's country of origin, under the terms set by the Spanish public entity where the adoptive family resides.
The OAA will appoint the person who will act as their representative before the authority of the country of origin, in accordance with the provisions established by the accrediting public entity.
Following the entry into force of Royal Decree 573/2023, of July 4, approving the International Adoption Regulation, the accreditation of organizations interested in performing international adoption mediation functions must be carried out following the procedure established in the current regulations of the autonomous community where the organization has its registered office.
The resolution of the public entity accrediting an organization to perform international adoption mediation functions will specify the functions and activities provided for in the current regulations, the determination of the country of origin for which the accreditation is granted, as well as the authorized costs for processing an adoption offer aimed at that country.
Regarding the number of OAA, the General Directorate for Children's and Adolescents' Rights, after consulting the Sectoral Commission, will establish annually the maximum number of international adoption mediation organizations that can operate in each of the countries of origin, considering, among other criteria, the limitation that, if any, each country of origin may establish regarding the number of foreign entities that can provide their mediation services.
Public entities accrediting mediation organizations will exercise monitoring and control functions concerning the overall functioning of the accredited organization within their autonomous community, as well as in relation to the activities they carry out in the country of origin.
The monitoring and control of the accredited organization that has processed an adoption file will correspond to the public entities where the people offering for adoption reside.

Chapter VI of Royal Decree 573/2023, of July 4, approving the International Adoption Regulation, contemplates the creation of the National Register of Accredited Bodies for International Adoption and Complaints and Incidents.
This Register is unique for the entire national territory and is attached to the General Directorate for Children's and Adolescents' Rights of the Ministry of Youth and Children.
The Register consists of two sections:
First section: Register of Accredited Bodies. This section is public, general and free. However, access to the data of the composition of the accredited body's technical team and its respective modifications, as well as to the identity of the representative in the country of origin, can only take place when the existence of a legitimate interest is accredited.
Second section: Register of Complaints and Incidents. Access to this section will be available, among others, to users of a mediation body who have submitted a complaint or incident regarding the services provided by it, both in Spain and in the country of origin, as well as the recipient bodies of these, regarding the files they have processed.
Access to the data in this Register can be made through the Electronic Headquarters of the Ministry of Health, for which a specific application form has been created, entitled “Procedures related to accredited bodies for international adoption” · You can access it through the following link:
To expand information regarding the use of this form, you can download the document with the “Instructions for accessing the data contained in the Register of Accredited Bodies for International Adoption and Complaints and Incidents”.
